Terms of Use

1. Operator and agreement

These Terms govern the Bedtime stories app for iOS and iPadOS and its supporting website (together, the “Service”). The Service is operated by Individual Entrepreneur Tal Serhii at 37K Saksahanskoho Street, Kyiv, 01033, Ukraine (“we”, “us”, or “our”).

By downloading, purchasing, or using the Service, an adult user agrees to these Terms. An adult who permits a child to use the Service accepts responsibility for the child’s use and for the choices made on the child’s behalf.

2. Apple licence terms

The app is licensed, not sold. These Terms supplement the Apple Licensed Application End User License Agreement (Standard EULA) and Apple’s applicable App Store rules. If these Terms conflict with mandatory Apple licence terms for the app, those Apple terms control to the extent of the conflict.

3. Users of different ages

The Service is designed for children, parent-and-child use, and adults. A child may independently read and listen to available stories. A parent or guardian must supervise the child as appropriate for the child’s age and circumstances and must make all privacy and purchase decisions for a child.

Entering or clearing a child’s name, making or deleting narration recordings, managing purchases and privacy controls, and opening external links are placed behind a short equation intended as an adult gate. The gate is a safety measure, not identity or age verification. Adults remain responsible for device settings, purchase authorization, and compliance with laws that apply to their family.

4. Personal licence and permitted use

Subject to these Terms, the Apple Standard EULA, and the applicable purchase terms, we grant you a limited, non-exclusive, non-transferable licence to use the Service and access unlocked content for private, non-commercial personal or family reading and listening.

You may use the app only on Apple devices permitted by Apple’s Usage Rules. No ownership of the app, story editions, illustrations, narration, music, design, or other protected material is transferred to you.

5. Service features and accounts

The app offers illustrated stories, standard narration, an optional child’s name, and private narration recorded by a parent or guardian. Some catalogue content is available without payment and some is locked.

The app does not create a developer-operated user account. iCloud features rely on the Apple Account signed in on the device, and purchases rely on the Apple Account used with the App Store.

6. Auto-renewable subscriptions and trial

Monthly and annual auto-renewable subscriptions unlock the complete catalogue while the subscription is active. The exact local price, currency, billing period, and renewal price shown by Apple before confirmation are part of the purchase terms. An annual subscription is billed at the full annual amount shown in the purchase flow.

Where Apple shows that an eligible user can redeem it, a subscription begins with a seven-day free trial. Eligibility is determined by Apple and may be limited to one introductory offer per subscription group. At the end of the trial, the subscription automatically converts to the selected paid plan at the displayed price unless it has been cancelled.

Subscriptions renew automatically for the selected period until cancelled. Apple charges the Apple Account under its billing rules. To avoid conversion of the seven-day free trial, cancel at least 24 hours before the trial ends.

Manage or cancel a subscription in Settings > [your name] > Subscriptions on iPhone or iPad. Deleting the app does not cancel a subscription. Cancellation stops future renewal and does not ordinarily remove access already paid for during the current billing period, subject to Apple’s rules and applicable law.

7. Individual story purchases

An individual story may be offered as a non-consumable In-App Purchase. Once completed, that purchase gives the purchasing Apple Account a non-expiring entitlement to unlock that particular story; it does not expire merely because a subscription ends.

A story purchase is a licence to access that story in the Service, not ownership of its text edition, artwork, narration, or files. Restoration and availability remain subject to the Apple Account, Apple’s App Store services and rules, device compatibility, legal requirements, and continued operation of the Service. Mandatory consumer remedies remain available if purchased content cannot be supplied.

8. Restore Purchases and Family Sharing

Use Restore Purchases in the gated parent area to restore eligible subscription or story access. Restoration requires the relevant Apple Account and a connection to Apple’s services.

We enable Apple Family Sharing for subscriptions and non-consumable story purchases where Apple makes the feature available. Actual sharing depends on Apple’s eligibility rules and the purchaser’s and family members’ account and sharing settings. Family Sharing applies to eligible purchase access only; it does not share the optional child’s name or private recordings.

9. Payments, taxes, and refunds

Apple processes App Store purchases, determines localized pricing and applicable taxes, and provides the transaction receipt. We do not receive complete payment-card information.

Refunds, reversals, and billing disputes are handled by Apple under its rules and applicable law. Requests can be submitted through Apple’s Report a Problem service. Nothing in these Terms limits a refund or other remedy required by applicable consumer law.

10. Optional name and private narration

A child’s name is optional and should be entered or cleared only by a parent or guardian. Only a parent or guardian may record narration. Recordings are for private family playback and may synchronize automatically through the user’s private iCloud database.

You retain any rights you have in your voice and recordings. You authorize the technical processing needed for the app and Apple’s iCloud service to store, synchronize, retrieve, play, replace, and delete them at your direction. We receive no right to publish, sell, advertise with, train artificial-intelligence systems on, clone, or otherwise commercially exploit the recordings.

The gated parent area provides controls to clear the name, delete one recorded line, delete all recordings for a story, or delete all recordings. More information is in the Privacy Policy and Privacy Choices.

11. Content and intellectual property

The app, website, original adaptations, editorial material, illustrations, narration, audio production, design, software, branding, and arrangement of content are owned by us or used under licence and are protected by applicable intellectual-property laws.

Some underlying traditional or historical works are in the public domain. Their public-domain status does not place our adaptation, editing, original illustrations, narration, recordings, or design in the public domain. 12. Prohibited conduct

You must not:

  • copy, extract, republish, sell, sublicense, publicly perform, or commercially exploit protected Service content except as permitted by law or written permission;
  • bypass paywalls, purchase validation, the adult gate, access controls, or other technical protections;
  • reverse engineer, modify, or create derivative works of the app except where applicable law or an open-source licence expressly permits it;
  • use automated means to scrape or systematically collect content;
  • interfere with the Service, iCloud synchronization, security, or another person’s use; or
  • use the Service unlawfully or infringe another person’s rights.

13. Third-party and external services

The Service relies on or links to services operated by third parties, including Apple, iCloud, the App Store, RevenueCat, Cloudflare, and informational websites. Their availability and handling of information are governed by their own terms and policies.

We do not control third-party services and are not responsible for their independent content, availability, or practices, except to the extent responsibility cannot be excluded by law. In-app external links are placed behind the adult gate.

14. Availability and changes to the Service

Internet, iCloud, App Store, and compatible device access may be required for synchronization, purchases, restoration, and updates. We may maintain, update, improve, or change the Service and its catalogue. Temporary interruptions may occur because of maintenance, security, network conditions, platform changes, or events outside reasonable control.

We may remove or replace content where necessary for legal, rights, security, or technical reasons. We will respect non-excludable consumer rights and provide any remedy required by applicable law for paid content.

15. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not promise uninterrupted or error-free operation, permanent availability of third-party services, or successful synchronization in every network or account condition.

The Service is for storytelling and entertainment. It is not medical, educational, psychological, childcare, or safety advice and is not a substitute for appropriate adult care or supervision.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from the Service or a third-party service, including loss caused by unavailable networks, iCloud settings, device loss, or unsuccessful synchronization.

We do not exclude or limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of non-excludable consumer rights, or any other liability that cannot be excluded or limited under applicable law.

17. Suspension and termination

You may stop using the Service at any time. Subscription cancellation must be completed separately through Apple. Rights granted under these Terms end if you materially breach them, subject to any notice or remedy rights required by law.

Provisions that by their nature should survive termination—including ownership, payment obligations already incurred, disclaimers, limitations of liability, and dispute provisions—continue to apply.

18. Governing law and consumer rights

These Terms and the relationship between you and us are governed by the laws of Ukraine, without applying conflict-of-law rules, except that this choice does not deprive a consumer of mandatory protections or access to courts available under the law of the consumer’s country of habitual residence.

Before starting a formal dispute, please contact us so we can try to resolve the matter. This request does not limit any right to contact a regulator, consumer-protection body, data-protection authority, or court.

19. Changes to these Terms

We may update these Terms when the Service, its business model, platform requirements, or law changes. The current version will be posted here with a new effective date. Material changes will be communicated in an appropriate manner where required and will not retroactively remove rights already acquired through a completed purchase.
